SW Florida Real Estate Insider -Tax Tips

It is almost that time of year again. Tax Time.

I know that most of you are thinking of Holiday Shopping and visiting family, but tax time weighs heavily on my mind! I am one of those procrastinators who wait until April 14 to find all of my year end paperwork, buy a tax software (too late to use a professional!) and spend 12 hours trying to organize a years worth of paper work into my tax returns.

When it was just my personal taxes it wasn't that bad; still painful, but manageable.
Once I opened my own real estate company however, it became a nightmare.

I always promise myself when I am in the middle of this nightmare that it will not happen next year! Well, we all know how that goes. I keep up with my day to day tasks for my work and family but accounting work just seems to get neglected.

So, I am trying to be ready for 2009 tax season and I found this article on the Florida realtor site with some tax tips that may help those of you who plan ahead.

SW Florida Real Estate - New Tax Breaks

Year-end tax game:
Act now to win on 2008 tax breaksWASHINGTON – Nov. 3, 2008 –

The end of the year is just around the corner, and it’s time to look back, look ahead and do your best to beat Uncle Sam at the tax game.
This year, we saw these changes, beneficial to the taxpayer:

Housing Act:

If you don’t itemize your deductions on your federal tax return for 2008, you can still take a property tax deduction on your real estate to increase your standard deduction. You’ll find that bonus on Page 2 of your 1040.

Also, if you are a first-time homebuyer (haven’t owned a home for at least three years), you’ll get a new credit if you purchased your home after April 8, 2008. (The credit applies into next year, too, for a home purchased before July 1, 2009.)

Your deduction is the lesser of these two options: 10 percent of the purchase price, or $7,500 (if married filing jointly or single, head of household), $3,750 (if married filing separately). This credit phases out if your income tops $150,000 (if married filing jointly or single, head of household) or $75,000 (if married filing separately).The credit operates like an interest-free loan and must be paid back over 15 years in equal annual installments, beginning the second year after you claim it.
It doesn’t apply to vacation or rental property – only to primary residences.

The new law reintroduces the 50 percent bonus depreciation on personal property, which was initiated after 9/11 to boost personal spending but expired in 2005. While mostly used by businesses, if you have a rental property, you can now take 50 percent of the purchase price of any personal property such as a stove or refrigerator for the rental. There is no cap on this.

Mileage deduction rates:

The mileage deduction rate changed twice – January and July.

Business miles are deducted at 50.5 cents per mile before July 1, 58.5 cents per mile after July 1.
Medical miles (going to and from doctors, lab tests, etc.) are deducted at 19 cents per mile before July 1, 27 cents per mile after July 1.

Also deductible are miles driven to make charitable donations. They stayed at 14 cents per mile, but remember, if you’re eating up gas miles while out and about, stop to drop off a donation, and you’ll get an extra deduction for your miles.

Smart moves Certified public accountant Sheryl Brown of Taking Care of Business recommends these strategies for reducing your tax bill:

Market losses:

If you sustained market losses in your investments this year and decide to pare off losers, do so before year-end. You not only get to offset these losses against capital gains in your securities transactions, but you also can take off another $3,000 (if married filing jointly or single, head of household) or $1,500 (if married filing separately) against your personal income, as well as carry forward additional losses for future years.

If you have profits in your investments, some with multiple purchase prices within the same stock or mutual fund, sell your highest cost shares, thereby reducing the capital gain that will be taxed.
Incidentally, investments held less than one year (short-term) are taxed at your usual marginal tax bracket, but those held a year or longer garner long-term capital gains, which in 2008 are taxed at the relatively low rate of 15 percent if you’re in the 25 percent marginal tax rate or higher. Starting this year, there is no tax on long-term capital gains if you are in the 10 percent or 15 percent tax brackets.

Retirement contributions:

Get 2008 contributions into your retirement plans by the end of the year, if they are solo 401(k) (your own business) and traditional 401(k) (you work for someone else).

With Roth and traditional IRAs, you have until April 15, 2009, to make your 2008 contribution. If you’re thinking of setting up a SEP IRA, it must be established by Dec. 31, but you have until April 15 to make your contribution.

Max out your retirement plan if you can: $15,500 for 401(k), $20,500 if you’re 50-plus; $5,000 for Roth and traditional IRAs, $6,000 if you’re 50-plus. If you’re older than 70, you also must elect to take your Minimum Required Distributions from your retirement plan by Dec. 31. (The first year you can wait until April 1 of the year after you turn 70).
Late withdrawals earn a 50 percent penalty.

Educational tax credits:

If you are a student or have student, remember that educational tax credits are dollar-for dollar against your taxes for qualified educational expenses.

The Hope Credit is $1,650. The Lifetime Learning Credit is $2,000.

There are also income tax deductions for tuition and fees, though you’re limited to choosing one of these three options per student per year.

Get it together-Don’t wait until 2009 to get a picture on your taxes.

If you’re itemizing deductions, get your receipts in order now.
If you use an accountant, schedule a visit now.
You may need to push excess income into next year or take more deductions in 2008.
You may want to make charitable donations and costly medical visits before the year’s end to count for 2008.
If you can see that you’ve underestimated your quarterly estimated tax payments, you can escalate your payment for the fourth quarter of 2008.

SW Florida Real Estate - Mold Issue? Don't Panic!

Too many times a buyer or seller find themselves in absolute confusion and worry about mold issues. A home inspection finds patches on a ceiling, an air conditioner maintenance person finds mold around the intake unit, a buyer sees what they think to be mold around a window etc.
Yes, mold does definitely exist in this world and specifically in humid climates like SW Florida but not every situation is as bad as one may think. Has the home been vacant for a long time? Has the AC and/or humidistat been kept at appropriate settings? Has there been water leaks and/or damage? Getting the most information from owners, listing agents and inspectors is essential to determining the level of concern. Not every home with a mold concern demands mitigation that costs thousands of dollars. Often it is just a matter of a good cleaning or Scrubber machine that pulls mold spores out of the environment.

Example:
Home tested positive for mold. The home did have a prior roof leak but the roof had since been replaced and was cleaned and sitting vacant except for the window treatments. Turns out the cloth window treatments had not been cleaned and dead mold spores were hanging out on them. A 24 hour Scrubber machine was brought in and the problem was resolved.
Example:
A Home inspection found "mold" and the sellers got two opinions from mold inspection companies that quoted them between $5,000-$10,000 to mitigate. The sellers went to one other company who I referred them to and they simply needed the Scrubber and a little cleaning due to the home standing vacant for a year and it cost the sellers approximately $1000.

This is not to say that there are not properties with major mold problems.
I recently previewed a condo with a customer and we had to leave immediately because the mold was everywhere. Walls, ceilings, windows and there was evidence of water damage as noted at the front door and perimeter. Even the lock box was rusting and the keys inside were corroded. Obviously that unit was going to need some serious work.

If you are a seller thinking of putting your home on the market, make an assessment of the state of your home. Is it as clean as can be? Do old leak stains need to be "Kilzed" and repainted? Have you looked at your AC intake unit and air vents lately? Clean, clean, clean before you open the doors for potential sellers. If you suspect a mold issue in your home, address the issue before an emotional buyer does.

But whether you are a seller or buyer, my main message is, don't panic. Get a professional assessment. If the result is worrisome and appears costly, get another opinion or two. There are many inspectors out there but not all have certifications and/or expertise with mold. Use your real estate agent for professsional and reputable referrals. I know I have a short list of inspectors that I refer to because I know they are not only experienced, reputable and cost effective, but they offer calm support to what otherwise can be a stressful situation.

SW Florida Real Estate Insider - How to Avoid Gated Community Buying Pitfalls

You may have heard about local communities in the Bonita Springs and Naples areas, such as Palmira Golf & Country Club and Quail West, that were experiencing financial distress regarding the operations of their amenities, but without going into the national economics and politics that are affecting to some extent, most communities throughout the country, here are some things to keep in mind when purchasing a home in sunny SW Florida.

There are ways to avoid such gated or resort style community issues:
Be aware:

Every home in a community with an association provides, or should provide, association disclosures including financials prior to a sale. Make sure you review those disclosures and financials with your real estate agent before going to close.
Be realistic:
If you are the person who wants the golf course view or social membership than 1) make sure you can afford the association fees and memberships
2) understand the consequences of not paying the association fees and memberships that you commit to and most importantly
3) have fun!
If you are NOT a golfer or tennis player or you don’t plan to purchase related memberships, then consider residential communities that do not have all those amenities and fees. Buy because you love it in SW Florida; buy because you love the house or condo; buy because the long term investment is the way to go.
Be smart:

Use a professional real estate agent. And one who will be detailed from start to finish for your home search, research, contract offer and closing.
Be brave:
Don’t regret missing your chance to own that SW Florida home at the amazing price of today. Real estate is a long term investment and 10 or 15 years from now or when your retirement rolls around, you WILL be happy to have a home or condo in SW Florida.
Be patient:
For example, if you fell in love with Palmira Golf & Country Club, do not lose heart. Allow the new committee of homeowners to work things out and you may end up with an even greater community run by the one’s who live there and love it there. Be confident:
No matter how a struggling community, a new President, Congress or Wall Street figure things out, when all is said and done, the fact is, SW Florida will still be SW Florida. The climate will still be fabulous, the beaches will still be relaxing, the Gulf of Mexico will still be glorious, the roads will be even greater improved and the people will continue to be friendly, active and having fun in sunny, beautiful SW Florida!

SW Florida Real Estate Insider- Avoiding Foreclosure

Tips on Avoiding Foreclosure


Are you living in what I consider southwest Florida- the Fort Myers- Bonita Springs- Estero- Naples areas? If so, I am sure you have either read or heard of the foreclosures that are in abundance.

Foreclosures occur for different reasons. Job loss, divorces, illnesses/ deaths, mortgage payment increases, are just a few of the reasons. The foreclosure is the end result of the borrower not being able to make their payments to the lender. When this happens, the lender "takes back" the property by foreclosing on it. The property is then "bank owned".

Foreclosures are not a pleasant experience on either side- the borrower loses their home and the bank adds a home to their REO list, which means it must be sold. (Lenders often say that they are in the business to lend money, not own real estate.)

So, how to avoid this?

First- stay aware of any changes in your financial situation. Has anything changed with your job? If hours have been cut, then less money is being brought home. This means that there is less money to pay bills- so the shortfall has to come from somewhere. The same goes for any situation where income is altered. Your income may have decreased because of an illness (which can also bring in additional bills.) What if you are divorced? Maybe the income has been cut in half. And what if your mortgage payments have gone up? Even with the same income, you have a problem, because now you have more monthly debt.

Second- Take immediate action to funnel more funds into the bill paying area of your life. Look at your "wants" and your "needs". Make sure you are using your money for things you need (think mortgage, food, electricity.) Be strict with yourself when you look at your "wants" and use leftover funds for that.

Third- If you find yourself in a situation where you cannot make the mortgage payments, you have options. You might be able to refinance. You might be able to negotiate with your lender and set up a payment plan. You might be able to sell your property and find a property to rent that has a monthly housing expense more in line with your income.

Above all else, don't be an ostrich! Sticking your head in the sand and ignoring the problem will not make it go away. It will only get worse unless you take action.

SW Florida Real Estate Insider - New GREEN Industry for SW Florida

The Nation’s economy, the real estate market and tropical storms have taken their toll on SW Florida but the area is still alive and well and has so much to offer. The ever-beautiful beaches, sunshine, year-round activity, health resources and great deals on home purchases are just a few of the outstanding benefits.






Did you know that SW Florida is growing a new energy crop?

Naples Daily News reported on it as well as the FreeReplublic.com in April, 2008. But in case you missed it, I think it’s big news for the area, the U.S. and the World. A new biodiesel that could power engines comes from a tree-shrub called the “Jatropha curas”. It produces a fruit with oily seeds that are crushed to produce a biodiesel. Research estimates that this plant can produce fuel 10 times more than corn and 4 times more than soy. My Dream Fuel LLC in LaBelle is cultivating the plant, should have as of this past June approximately 2 million seedlings planted in a nursery in Hendry County, is opening a seed crushing and plant cloning center at the State Farmer’s Market in Fort Myers and is approaching citrus farms with diseased trees and cattle ranchers to diversify with the Jatropha curas plant. Being one of the first companies to do large plantings of the shrub-tree in the United States has inspired a local start-up company, Sunshine Biofuels, to build an alternative fuel processing plant possibly in Immokalee, Collier County.

A wonderful testament to the ingenuity and spirit of local SW Floridians and an example of how a “Slow Home type of thinking “Go Local”: Supporting the local economy is essential to keeping your community alive and well can make a positive difference in SW Florida which in turn will affect the economy, the real estate market, the U.S. and the World.

SW Florida Real Estate Insider-Biking in Fort Myers

My husband and I are occasional avid bike riders. Kind of contradictory, I know, but that seems the best way to describe us. We have a recumbant tandem (2 person bike with low reclining seats) which although low and a little hard to balance is very comfortable and we can ride all day. We hadn't used the bike in quite a while and hauled it out of the back of the garage a few weeks ago and started taking morning rides before work.

The Daniels road corridor in Fort Myers (between I-75 and 41) has a great path that runs along the North side and connects to the new 10 mile linear park and also connects to Six Mile Cypress which also has a great biking path. We can take an hour long ride in the am with some great views. If you have time for a longer ride you can do the loop from Daniels to the 10 mile linear park to Colonial Blvd, connect to Six Mile Cypress head South and Stop at the preserve for a walking tour before heading home. Florida has a great climate for year round biking and it is great exercise. We need more bikers taking advantage, we don't have near enough biking lanes in our great state and showing that we use the ones we have is the first step to getting more of them.

SW Florida Real Estate Insider- Foreclosures in SW Florida

Yes, folks, according to news sources, foreclosures are still on the increase. Due in part to property values dropping, people losing their jobs, and adjustable rate mortgages adjusting upward, the number of foreclosures keep rising. The metro area of Cape Coral and Fort Myers was #1 in the nation for July 2008 for foreclosures, according to the article.


The upside of this is that now is a great time to buy. Prices are down and there are a lot of properties on the market. And foreclosures are often priced below non-foreclosure listings-another opportunity for you to buy at a great price.


Things to keep in mind in looking at foreclosures:


--The properties that are priced aggressively go quickly- don't sit and ponder- if you want the property, make an offer.


--Be realistic on pricing- educate yourself so that you know where the price points are (don't hold out for the impossible deal- it may be impossible to get.)


--Foreclosed properties often need "fixing up". You will need money for this- unless you take out a loan that will incorporate repairs (see "Rehab Loan" label on our blog.)


--Make sure you have inspections done. A lot of properties have been sitting vacant, with the electric and water turned off. Remember the humid climate of the Fort Myers- Estero - Bonita Springs area. (Think mold, and think bugs.)

--Take stock of your situation. Do you own a home? If not, now is a really good time to start the search. If you do own a home, consider buying investment property- again, it's a great time.

The key to being ready for a disaster is to be ready before it strikes. Thanks to the constant up-to-the-minute news of the local stations in Fort Myers, Estero and Bonita Springs, we are provided with current news on Hurricane Ike. Now it is up to us to make sure we are prepared.


Do you have an emergency kit? According to the American Red Cross, http://www.redcross.org/services/prepare/ , there are six basics to any emergency kit:

--Emergency Supplies
--Special Items for Emergency Conditions

  • Small fire extinguisher

  • Tube tent

SW Florida Insider- Hurricane Preparedness

Are You Really Ready for this Hurricane Season?

Two (of the many) things that are certain in SW Florida every year are lots of sunshine and the very real possibility of tropical storms and hurricanes impacting our area.
When Fay became tropical last week, I pulled out my hurricane list of "things to do" to make sure I was ready. This list is very detailed and is the best one I have seen- that is why I keep and use it. It is from USA Today, November, 2005, and is part of an article created as a result of Hurricane Katrina and the devastation it created ("Are You Prepared in Case of Disaster?" by Elizabeth Weise, page 9D.)
The article is divided into nine sections, with a list in each one:

--First Aid (do you have the 17 essential items?)
--Pets (do you have a pet carrier...food...litter...ID and vaccination records?)
--Home Emergency Kit (32 items in this list, plus airtight plastic bags for everything)
--Food (ideas to sustain your body and comfort your soul as you battle the storm)
--Water (did you know that water has a shelf life of six months? It is because the plastic water jug it is in may develop tiny cracks that allow bacteria into the water)
--Shelf Life of Food (vital info- you don't want to eat something that will make you sick- especially when you have no electricity and possibly no access to a doctor)
--Important Documents (another 17 item list, with a note to keep the originals in an off site safe deposit box)
--Maintaining Contact (great ideas on maintaining contact with family members, both in the storm and outside of it. Remember to put "ICE" in your phone)
--Evacuation Bag (16 items- all needed to be inside a bag with ID for each family member).

This may look overwhelming, but wouldn't it be better to start out overwhelmed and end up absolutely prepared, than to just "wing it" and possibly suffer the consequences?

SW Florida Insider - GO GREEN Real Estate. What is the “Slow Home” Movement?

Founded by the Calgary University Professor of Architecture, John Brown,Slow Home is an international movement that provides design information and empowers homeowners to take more control and improve the quality of their home environments. Inspired by the clear lessons of “slow food” versus “fast food”, here are Professor Brown’s 10 steps to embrace a higher quality home and lifestyle and SW Florida area real estate expert, Lisa Farina-Lopez’s responses and local advice.

1) “GO INDEPENDENT” Find independent designers and contractors who design for you and not just profit. We have right here in the greater Fort Myers-Bonita Springs- Naples area, a number of local architects, designers and various service contractors who understand the desire for unique combined with the concerns for finances, preservation and conservation.

2) “GO LOCAL”
Use local craftsmen, manufacturers and retailers to get a local response to your needs rather than relying on the standard “Big Box” companies who often do not understand your unique home conditions. Think how great it would be to create a network of service professionals who are a “stones-throw-away” from your doorstep and how that makes for pleasant neighbors who are happy to know you and work for you. Supporting the local economy is essential to keeping your community alive and well.

3) “GO GREEN”
Help stop the new suburban sprawl by investing in existing communities and using sustainable materials to help reduce one’s "environmental footprint". There is an abundance of resale homes available here in our SW Florida area. Rather than clearing more land to build, consider revitalizing a pre-existing home and neighborhood. And while doing so, you can choose to use, for example, phosphate free cleaning supplies, less toxic paints and lawn care companies who use organic fertilizers.

4) “GO NEAR”
With the cost of gasoline and the general cost of living rising, it is more important than ever to live as close to where you work, shop and play. It is not just the wasted time and resources driving to work, grocery store, post office, gym etc. but the continued need for new roads and infrastructure services that play a huge role in negatively impacting your beautiful SW Florida environment. Even larger developers are beginning to understand this need as Rappallo, Coconut Pointe and the Mercado are three local communities that promote a multi-use, lifestyle where one walks to work, shop, eat or play.

5) “GO SMALL”
Bigger is not always better. Any properly designed home can feel bigger and live easier than the biggest yet poorly designed one. With the economy pinching most people’s wallets it is so important to spend your money wisely on quality instead of quantity. And think about the money to be saved on less space to air condition or clean. There are many lovely smaller and moderately sized condos, townhouses, cottages or single family homes in the Bonita Springs area just waiting for the ”slow home” owner!

6) “GO OPEN”
Many homes were built to keep the house dark in Florida with the thinking that less light equals less heat, but it often created small, closed up rooms that require more electricity for lighting and don’t really work with the flow of daily lives. How many homeowners have to walk around the house looking for tv’s or lights left on? Choose to build or renovate to create an open space that flows with your daily life, reduces electricity use and offers great light to lift your spirits and remind you of the beautiful SW Florida nature right outside your window. Courtyard homes and homes with “great-rooms” are very popular here in Florida for this reason.

7) “GO SIMPLE”
Buy or renovate a home that has space you will use and things you need. How many homeowners have rooms they never use or worse yet, become interior dumping grounds? And to think that space is costing you money in air conditioning, insurance and real estate taxes. Good design reduces waste, clutter and saves you money. Buy or redesign a home that fits the lifestyle you really want. Homebuyers are becoming more attracted to open floor plans and great rooms.

8) “GO REAL”
Create a home that reflects your own quality of character and high ideals by avoiding fake materials or inaccurate historical styles. You can enhance a home's character with the use of space, natural light, the placement of personal possessions and the use of sustainable materials. Florida is known for it’s Cypress wood and many older homes were entirely or partially built from it. Cypress wood is a super hard wood that is termite resistant and very durable. If your Ft. Myers, Bonita Springs, or Naples home is older with wood floors, walls or main structure, make sure you learn the type of wood it is as you may already have the “go real” you would want as a “slow home” owner. Coral rock is another indigenous element you can use to enhance your home area. If you have questions about authenticity ask your local experts.

9) “GO HEALTHY”
It is commonly known that houses built with cheap materials can emit noxious chemicals. So be money conscious but wise and use as natural as possible of materials and techniques in your building and/or renovating. Consider adding a fresh air ventilator system to your air conditioner to keep fresh air diluting any gases. And it doesn’t take but one “Today Show” episode to know that suburban living which demands driving for all one’s needs can support obesity. This goes back to Prof. Brown’s “GO NEAR” step to not only save money and resources but to promote a healthier you by living where you can walk or bicycle to work or shop.

10) “GO FOR IT”
The more you get informed and involved with your home, the better for everyone and everything! It’s time to slow down Mr. or Ms. Homeowner to understand and create what it is you really want and know that every big or small change made is so important. Not only do you have the opportunity to enjoy your home more fully but reconnect with and support your community and natural environment, save money, enhance your properties value and be proud of your efforts and the changes.
